Employer Checking Service (ECS)
The Employer Checking Service (ECS) can be used to request verification from the Home Office that an individual has the right to work in the UK in the following circumstances:
- A new staff member is unable to provide the required right to work documentation because they have made a visa application or appeal which has not yet been decided.
- A new staff member has an endorsed expired passport and has made an application for a Biometrics Residence Permit (BRP).
- An existing staff member has made an application to extend or switch their visa or applied for Indefinite Leave to Remain (ILR), and their current visa has expired before an outcome has been received.
- The individual holds an Application Registration Card or a Certificate of Application which is less than six months old. These documents are not commonly presented.
Step 1 - Obtain consent
Request and retain a copy of Home Office letter/email confirming an application or appeal has been made.
Advise the individual that the ECS will be used to confirm their right to work in the UK. Individuals consent is required
