Domestic Relationships and the Law Commission's Consultation Paper

SLSA small grant-funded one day workshop on cohabitation

The one day workshop on Cohabitation is part of a series of one-day workshops organised by Kent Law School; the first was held in June 2003, followed by a second workshop in September 2005. With the publication of the Law Commission’s Consultation Paper (expected by June 2006), the funding for this one-day workshop by a SLSA small grant could not be more timely.

The aim of the workshop is to enable the group to consider and discuss the Law Commission’s Consultation Paper on Cohabitation and the implications of the Commission’s proposals for cohabitants (opposite and same sex), both legal and fiscal, with a view to drafting proposals for a group response to the Consultation Paper.

Some of the key questions which the 2006 workshop will be concerned with are:

  • whether the marriage model for domestic relations is being stretched in an unsuitable way;
  • whether the Law Commission’s proposals address the reality of contemporary patterns in cohabitation and other domestic relationships;
  • whether the remit of the Law Commission Paper (limited to couple-based cohabitation) is too narrow;
  • the extent to which the proposals may have a differential impact (and a possible detrimental impact) on cohabitation relationships.

When the speakers are confirmed, the programme for the workshop will be available on the Kent Law School’s web site (www.kent.ac.uk/law/).
